Professional liability insurance

The partnership has professional liability insurance in accordance with Sections 59n, 59o Federal Lawyers' Code (BRAO) with Ergo Versicherung AG (Ergo-Platz 1, 40477 Düsseldorf). The territorial scope of insurance coverage includes legal advice in the member countries of the European Union and meets at least the legal requirements in accordance with Sections 59n, 59o BRAO.

The notary has financial loss liability insurance with Ergo Versicherung AG (Ergo-Platz 1, 40477 Düsseldorf), with an insurance sum of 5 million euros per insured event.

The Lawyers' Remuneration Act (RVG) states that the fees and expenses of attorneys' remuneration are calculated according to the value of the subject matter of the legal activity. This is either the monetary claim that is required by the client or, e.g. in the event of a divorce or termination, the value of the matter. In the event of a dispute, a court will appoint him. Our law firm's activities are billed either in accordance with the Lawyers' Remuneration Act (RVG) or, if billing is to be carried out in another way, in accordance with fee agreements (§ 34 RVG) and remuneration agreements (§ 3a et seq. RVG), which are agreed with the client before taking on the mandate.

The amount of remuneration is determined in accordance with the schedule of remuneration Appendix 1 to the RVG. In the event of a dispute, the amount of the remuneration determined by the lawyer is reviewed by an expert opinion from the Bar Association.

General mandate conditions

Our General mandate conditions apply to all services to be provided by Dr. Krafczyk und Partner Rechtsanwälte mbB, in particular the provision of advice and information and representation in legal matters, including any litigation

If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, Hanover is agreed as the exclusive place of jurisdiction for all claims arising from or due to the client relationship. The same applies to persons who have no general place of jurisdiction in Germany or persons who, after conclusion of the contract, have moved their place of residence or habitual abode outside Germany or whose place of residence or habitual abode is unknown at the time the action is brought.

Alternative dispute resolution

In principle, we are not obliged to participate in dispute resolution proceedings before a (consumer) arbitration board, but we are prepared to do so. In the event of disputes between lawyers and their clients, it is possible, upon request, to settle disputes out of court at the Celle Regional Bar Association, Bahnhofstr. 5, 29221 Celle, www.rak-celle.de (see Section 73 Paragraph 2 No. 3 in conjunction with Section 73 Paragraph 5 BRAO) or at the Arbitration Board of Lawyers, Neue Grünstr. 17, 10179 Berlin, www.schlichtungsstelle-der-rechtsanwaltschaft.de (the latter also an arbitration body under the Consumer Dispute Settlement Act).
